Charter Policy
Payment Terms & Conditions
A NON-REFUNDABLE deposit of $1,000.00 is due at the signing of this contract. Dates will only be held with a deposit and signed contract. The balance amount (based upon the guaranteed passenger count subject to the vessel maximum passenger count) and a $250.00 damage deposit are due in full 10 davs prior to the charter date or charter will be cancelled. The guaranteed passenger count may not be exceeded under any circumstances. Passengers in excess of the guaranteed passenger count will not be allowed to board vessel. All applicable charter fees are forfeited should the Charterer, for any reason, decide to cancel. In cases of severe weather, or by governmental direction, the vessel will remain dockside for the length of the event. If charter must be cancelled by Diamond Jack's, Charterer will be offered an alternate available date.
Catering
Catering may be brought on board for an additional $300.00. All outside caterers are to be licensed, insured and are responsible for accompaniments to catering (i.e. plates, silverware, napkins, table cloths) and provide necessary set up and clean up both during and at the end of charter.
Liquor
Diamond Jack's River Tours is fully licensed by the State of Michigan for liquor sales. Beverages are not allowed to be brought on board or removed from vessel at any time. No one under the age of 21 will be served alcoholic beverages. Proper identification is required. Alcoholic beverages cannot be served until the vessel has fully departed the dock. Bars will close 15 minutes prior to docking without a formal announcement.
Entertainment
Diamond Jack's River Tours must approve size and type of entertainment. The charterer is responsible to inform the entertainers to contact Diamond Jack's River Tours office 7 days prior to the charter date to discuss boarding arrangements.
Advertising
Copies of all arrangements promoting a 501(c)(3) non-profit fundraiser aboard Diamond Jack's River Tour vessels must be approved by Diamond Jack's before distribution. All advertisements must contain the restrictions pertaining to liquor and legalities. Diamond Jack's may cancel the charter if advertisement is unacceptable.
Boarding
Boarding locations other than Diamond Jack's River Tours docking facilities must be arranged and paid for in advance with Diamond Jack's River Tours. Dockage fees for these location are the responsibility of the charterer. Guests may board 15 minutes prior to the scheduled departure time.
Disembarking must be no later than the time on the signed agreement. Decorators, entertainers, and caterers may board 1 hour prior to the contracted departure time and disembark no later than 15 minutes after the completion of the charter. There will be a charge of $50.00 per every 15 minutes for lateness of disembarkation.
Ticket Sales
Diamond Jack's River Tours prohibits the sale of tickets to its charters for profit by the charterer (or any persons affiliated with the charterer) and reserves the right to cancel any charter and retain the deposit, which violates this policy. This prohibition shall not apply to legitimate non-profit and/or charitable organizations who are conducting a not for profit fund raising event wherein all proceeds over the cost of the charter and catering, if any, are provided to the organization which is the charterer. Diamond Jack's River Tours requires Charterer to provide proper authentication and proof of Federally approved Non-orofit Charitable Organization 5010(3) status prior to booking any reservation or drawing of Charter Contract.
Legalities
The m/ Diamond Jack, m/ Diamond Queen and the m/v Diamond Belle are U.S.C.G. certified passenger vessels. Charterer is reminded that their event is taking place aboard a vessel while docked or underway. We recommend wearing flat shoes for all events. Wearing of high heels or stilettos is at passengers own risk.Any illegal substances and/or weapons discovered on board the vessel will be just cause for notifving the proper authorities and immediate termination of the charter. Charterer is responsible for all damages done to the vessel and/or its equipment by its passengers. The Crew reserves the right to restrain, disembark, or refuse boarding of any passenger or passengers at any time. whose conduct leopardizes the safety or property of the vessel, or the reputation of the owner, crew or vessel itself. In situations of this kind, refund of charter fees will not be made in whole or part: nor shall the owner assume any obligation whatsoever. Charterer shall indemnity, hold harmless, and defend Diamond Jack's River Tours, the m/ DIAMOND BELLE, the my DIAMOND QUEEN, the my DIAMOND JACK and their management, vessel crew, and all of their respective agents, officers, directors, owners and employees against any and all loss arising out of third party claims attributable to the actions or admissions of the Charterer, its employees, agents, and/or subcontractors that provide services or products with respect to this contract including reasonable attorney fees. No suit shall be maintainable against Diamond Jack's, or its vessels for personal injury, illness or death of any passenger unless suit is commenced (filed) within one (1) year from the date of such injury, illness or death and process served within 120 days after filing, not withstanding any provision of law of any state or country to the contrary.
